Terms of Service

1. Agreement to Terms

By accessing or using RSVP Platform("the Platform," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all users — Organizers hosting events, administrators and staff invited to manage those events, and Participants RSVPing to events.

2. Description of Service

RSVP Platformis a multi-tenant event RSVP management platform. Independent organizations ("Organizers") use the Platform to publish events, accept and moderate RSVPs, collect optional waivers and payment status, and check attendees in at the door. Participants use the Platform to RSVP to those events, view their RSVP status, and present a check-in QR code at the event.

3. Definitions

  • Organizer: an organization (nonprofit or for-profit) that has been onboarded onto the Platform and uses it to host events.
  • Organizer Admin / Staff:an individual invited by the Organizer to administer the Organizer's account or to staff a specific event (e.g., gate check-in).
  • Participant:an individual who RSVPs to an event published on the Platform. Participants do not need a Platform account to RSVP — they enter their details directly into the event's public RSVP form.
  • Event: a single occurrence (or series of occurrences) published by an Organizer with its own title, date, location, capacity, and pricing options.
  • RSVP: a single registration record tied to a Participant + Event, including their party size, optional notes, selected ticket / pricing tier (when offered), answers to any custom questions the Organizer added to their RSVP form, and status.

4. User Accounts

Account Creation

To act as an Organizer admin or staff member, you must create an account or accept an invitation from an existing Organizer admin. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Enable two-factor authentication when prompted (required for Platform administrators; recommended for all Organizer admins)
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

Account Termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose a security risk to the Platform or other users. You may close your account at any time by contacting support@jbcre8iv.com.

5. Participant RSVPs

Participants do not need to create a Platform account to RSVP. By submitting an RSVP form, you confirm that the information you provide is accurate and that you are authorized to RSVP on behalf of any minors or additional guests in your party size.

Each Organizer determines the rules for their own events, including which information is required, the custom questions (if any) added to the RSVP form, how RSVPs are moderated (open / approval-required / invite-only), and any cancellation deadline. The Platform enforces those rules but does not set them.

If an event is full, an Organizer may offer a waitlist. Joining a waitlist does not guarantee a seat. If a seat opens, the Platform will email you an offer that you must accept within the offer window the Organizer has configured (typically 24 hours). Offers that go unanswered are automatically declined and the seat is offered to the next person on the waitlist.

6. Payments

RSVP Platform does not process payments directly. When an Organizer requires payment to confirm an RSVP, they collect payment from Participants through their own external payment channels (e.g., Venmo, PayPal, Cash App, Stripe, in-person at the gate). The Organizer is solely responsible for accepting, recording, processing, and refunding any payments collected for their events.

An Organizer may also connect a Stripe account to the Platform via Stripe Connect. At present, the Platform uses this connection only to confirm the Organizer's eligibility to receive Stripe payments — the Platform itself does not yet process charges or refunds on the Organizer's behalf. We will update these Terms and the Privacy Policy before any change in how payments are routed through the Platform.

The Platform records only payment metadata: the amount due, the amount paid (if any), the date and method the Organizer marked the payment received, and any refund the Organizer records (method, reference identifier, amount, date). The Platform does not initiate, hold, or transmit refund funds. We do not see, store, or transmit Participant payment card numbers or external payment-account credentials.

Refund requests must be directed to the Organizer of the event. The Platform does not mediate refund disputes between Participants and Organizers.

7. Electronic Waivers

When an Organizer requires Participants to sign a waiver before attending, the Platform routes Participants to Smartwaiver to complete the signature. Smartwaiver is the system of record for the signed waiver document; the Platform receives only completion metadata (timestamp, document id, link to the signed PDF).

The waiver itself is a legal agreement between the Participant and the Organizer. The Platform does not draft, review, endorse, or enforce the contents of any waiver, and is not a party to the waiver agreement. Each Organizer is responsible for ensuring that the waiver they require is appropriate for their event and their jurisdiction.

8. Check-In QR Codes and Wallet Passes

When a Participant's RSVP is fully confirmed (every applicable gate — approval, payment, waiver — has passed), the Platform sends the Participant an email containing a unique check-in QR code. The QR code:

  • Is single-use authentication for that specific RSVP, and also lets the Participant view their own status page;
  • Can be regenerated by the Participant by viewing their status page in any browser (it pulls the same QR live), so losing the email does not prevent check-in;
  • Should be presented to the Organizer's staff at the event for scanning. Once scanned and confirmed by the Organizer's staff, the RSVP is marked checked in.

For convenience, the Platform can also generate an Apple Wallet or Google Wallet pass containing the same check-in QR code. The pass embeds your name, the event details, and the QR; saving the pass to your device gives you a copy you can present at check-in even without access to the email. If your RSVP is cancelled or the event is cancelled, the Platform will mark the pass as expired.

Sharing the QR code, its underlying URL, or your wallet pass with someone else may allow them to check in under your name. Treat them like a ticket.

9. Capacity and Tier Pricing

Organizers may configure events with overall capacity caps, per-tier capacity caps, or shared per-day capacity pools (for multi-day events). The Platform enforces these caps in real time at intake and rejects RSVPs that would exceed any applicable cap.

Capacity enforcement is best-effort under typical concurrency levels. In the rare case of simultaneous RSVPs reaching the same final seat, the Platform may briefly accept one beyond the cap before rejecting subsequent attempts. The Organizer is the final arbiter of whether to honor a borderline RSVP and is responsible for any capacity-related decisions about their venue.

Pricing tier selections are bound to the RSVP at intake. A Participant may self-serve change their tier from their status page only if their payment has not yet been recorded by the Organizer; after payment, all tier changes must be coordinated with the Organizer directly.

10. Cancellations and No-Shows

Each Organizer sets their own cancellation policy and cancellation deadline. When the Organizer enables participant-initiated cancellation, the Participant may cancel their own RSVP from the status page up to the configured deadline. After the deadline, cancellation requests must be directed to the Organizer.

The Platform may automatically cancel and release seats for advance-payment RSVPs that have not been marked paid by the Organizer within the Organizer-configured payment window. Participants will receive an email reminder before any such auto-cancellation.

Waitlist offers expire automatically if the Participant does not accept them within the offer window the Organizer has configured (typically 24 hours); the seat is then offered to the next person on the waitlist. See Section 5.

The Platform does not issue refunds — see Section 6.

11. Organizer Responsibilities

By using the Platform as an Organizer, you agree to:

  • Provide accurate organizational information (name, contact email, mailing address when applicable, brand assets).
  • Publish accurate event details — title, description, date, location, capacity, pricing, cancellation policy, and any waiver requirements.
  • Honor RSVPs that the Platform has confirmed on your behalf, or communicate with the Participant directly about any changes (e.g., event cancellation, rescheduling, capacity reduction).
  • Handle Participant data only for the purposes of running your event, complying with applicable privacy laws (GDPR, CCPA, COPPA, and any local equivalents). You are the data controller for the information your Participants submit through your event's RSVP form, including any answers to custom questions you add — collect only what you need and be prepared to respond to subject-access and deletion requests your Participants may make.
  • Process and refund any payments collected for your events outside the Platform, in accordance with your stated policies and applicable consumer protection laws. If you record refunds in the Platform, the metadata you enter (method, reference, amount, date) is a record of the refund — it does not cause the Platform to move funds.
  • Issue any tax receipts your jurisdiction requires (the Platform marks RSVPs as tax-deductible based on your organization type but does not generate or send tax documentation).
  • Maintain valid authorization to use the email domain configured for outbound transactional email (verified through Brevo, our email provider).
  • If you enable Stripe Connect, complete Stripe's own onboarding and verification requirements directly with Stripe. The Platform receives only your connected-account status from Stripe; you remain responsible for the accuracy of the information you submit to Stripe.
  • Comply with all applicable laws and regulations, including anti-discrimination laws and event-host liability statutes in your jurisdiction.

12. Participant Responsibilities

By RSVPing to an event on the Platform, you agree to:

  • Provide accurate contact information so the Organizer can reach you with event-related updates.
  • Pay any required amount through the channels the Organizer provides, by the deadline they set, if you wish to keep your spot.
  • Sign any required waiver before attending.
  • Cancel your RSVP if you can no longer attend, so the Organizer can release your seat to another Participant.
  • Comply with the Organizer's code of conduct, venue rules, and any other event-specific policies.

13. Prohibited Activities

You agree not to:

  • Use the Platform for any unlawful purpose
  • Submit false, misleading, or fraudulent information
  • Impersonate another person, organization, or Organizer
  • Attempt to gain unauthorized access to other Organizers' data
  • Interfere with the proper functioning of the Platform (e.g., automated scraping, denial-of-service attacks)
  • Bypass capacity limits, payment requirements, waiver requirements, or invitation-only restrictions
  • Use stolen or unauthorized payment methods to pay an Organizer
  • Use the Platform to harass, threaten, defame, or send spam to other users
  • Reverse engineer, decompile, or otherwise attempt to extract source code from the Platform

14. Intellectual Property

All content, features, and functionality of the Platform — including the underlying source code, design, branding, and documentation — are owned by JB CRE8IV (the operator of the Platform) and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Each Organizer retains ownership of their own brand assets (logo, color palette, event content) uploaded to the Platform and grants the Platform a non-exclusive license to display and process those assets solely for the purpose of operating the Organizer's account.

15. Disclaimer of Warranties

The Platform is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that the Platform will be uninterrupted, secure, or error-free.

We make no representations or warranties about any individual Organizer or any event published on the Platform, including the accuracy of event details, the legitimacy of the Organizer, the safety of the event venue, the suitability of the event for any particular Participant, or the Organizer's compliance with applicable laws. Participants engage with Organizers and attend events at their own risk.

16. Limitation of Liability

To the fullest extent permitted by law, RSVP Platform and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to:

  • Personal injury, property damage, or financial loss arising at or in connection with any event published on the Platform
  • Disputes between Participants and Organizers regarding payment, refunds, attendance, conduct, or service quality
  • Loss of data, inability to access the Platform, or delivery failures of transactional email
  • Any decision made or action taken by an Organizer based on Platform-provided data
  • Failures of third-party services we depend on (Supabase, Brevo, Smartwaiver, Cloudflare, Vercel, payment processors used by Organizers)

Our total liability for any claim arising out of these terms or your use of the Platform shall not exceed the greater of (a) the amount of fees you have paid to us in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).

17. Indemnification

You agree to indemnify and hold harmless RSVP Platform, its operator, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Platform, your violation of these terms, your violation of any third party's rights, or — for Organizers — any event you publish on the Platform.

18. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes by posting the updated terms on this page and updating the “Effective Date” at the top. For changes that materially expand user obligations or reduce user rights, we will provide additional notice (typically via email to your registered account address) before the change takes effect. Your continued use of the Platform after changes constitutes acceptance of the modified terms.

19. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Indiana, United States, without regard to its conflict of law provisions. Any disputes that cannot be resolved informally shall be resolved in the state or federal courts located in Indiana, and you consent to the exclusive jurisdiction of those courts.
